Amplify Care EMR Tools: Terms and Conditions
- By using this product, the Customer acknowledges that the EMR tool is the property of Amplify and/or its licensors. Amplify will at all times maintain sole and exclusive title, ownership and intellectual property rights to tool design, code and features. No copyright or other intellectual property rights will be granted to the Customer or implied by waiver or estoppel. The right to use this EMR tools and supports does not give the Customer any right to implement any Amplify or licensor intellectual property in the EMR tools and support.
- Amplify provides the EMR tools and supports on an “as is” and “as available” basis and the Customer agrees that they use the EMR tools and supports at their own risk. EMR tools and supports are provided without any representation, warranty or condition of Amplify or any of its licensors or Third Party Providers including that the EMR tools and supports will be uninterrupted, timely, secure, virus free, error free or suitable for any particular purpose or any warranty of quality, title, non-infringement or merchantability. Amplify does not guarantee any level of availability, quality or problem resolution including resolution time in relation to the EMR tools and supports. At its sole discretion, Amplify may suspend or terminate support of the EMR tools and supports, at any time, for any reason, by any or all of the Customers.
- Amplify is not responsible or liable for the privacy practices or compliance of privacy related obligations of any Customer, including, but not limited to, a Customer’s compliance with PHIPA.
- By using this product, the Customer acknowledges that they are required to exercise their own clinical judgment in using this tool. Amplify Care, including their respective agents, appointees, directors, officers, employees, contractors, members, or volunteers, do not:
- provide medical, diagnostic or treatment services through this Tool;
- accept any responsibility for the use or misuse of this Tool by any individual including, but not limited to, primary care providers or entity, including for any loss, damage or injury (including death) arising from or in connection with the use of this Tool, in whole or in part; or
- give or make any representation, warranty or endorsement of any external sources referenced in this Tool (whether specifically named or not) that are owned or operated by third parties, including any information or advice contained therein.
